The latest iteration of discriminatory legislation aimed at the transgender community is House Sub for SB 233. KNEA President Schwanz wrote an open letter to members in March outlining the dangers of this bill. Unfortunately, this legislation passed. Last week, Governor Kelly vetoed this bad legislation. That is the only good news. The bad news is that the margins to sustain her veto are razor-thin. In addition to the horrible nature of the bill, the bill lacks a definition of “state employee.” This is a problem because it leaves it open to interpretation to encompass public schools and all public school employees. This broad approach is ripe for misrepresentation and misuse.
